Basic Terms

2. You are responsible for any activity that occurs under your screen name.
3. You are responsible for keeping your password secure.
4. You must not abuse, harass, threaten, impersonate or intimidate other MyDataPilot users or anyone else.
5. You may not use the MyDataPilot service for any illegal or unauthorized purpose. Users agree to comply with all laws of any jurisdiction that are applicable to their online conduct as well as any related or consequential offline conduct. These may include but are not limited to laws in the user's place of residence, local laws in the area where MyDataPilot was accessed from, laws in CA, US, where Susteen Inc. is incorporated, and laws in the USA where MyDataPilot servers are located.
6. You are solely responsible for your conduct and any data, text, information, screen names, graphics, photos, and links (Image Content) that you submit, post, and display on the MyDataPilot service.
7. MyDataPilot is intended as a public image bookmarking service for individuals. Its use for any other purpose, including but not limited to professional, promotional or corporate purposes is prohibited.
8. You agree not to contribute or bookmark any content that is infringing, libelous, defamatory, obscene, pornographic, abusive, offensive or otherwise violates any law or right of any third party or MyDataPilot.
9. You must not modify, adapt or hack MyDataPilot or modify another website so as to falsely imply that it is associated with MyDataPilot.
10. You must not create or submit copyrighted images that are protected by any of the commonly accepted protocols for book-marking.
11. You must not transmit any worms or viruses or any code of a destructive nature.
12. You must not, in the use of MyDataPilot, violate any laws in your jurisdiction (including but not limited to copyright laws).

Violation of any of these agreements will result in the termination of your MyDataPilot account. While Susteen Inc. prohibits such conduct and content on its site, you understand and agree that Susteen Inc.cannot be responsible for the content posted on its web site and you nonetheless may be exposed to such materials and that you use the MyDataPilot service at your own risk.

General Conditions

• Susteen Inc. reserves the right to modify or terminate the MyDataPilot service for any reason, without notice at any time.
• We reserve the right to alter these Terms of Service at any time. What constitutes a "material change" will be determined at our sole discretion, in good faith and using common sense and reasonable judgment.
• We reserve the right to refuse service to anyone for any reason at any time in part or in full. This may include but is not limited to refusal to create a user account, deletion of an existing user account, deletion or addition or modification of any bookmarks marked by a user.
• We may, but have no obligation to, remove Content and accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Use.
• Susteen Inc. controls and operates this Site from CA, US and makes no representation that the Site or the Materials are appropriate for use in any locations other than US. If you use this Site or the Services from outside US, you are entirely responsible for compliance with applicable local laws, including but not limited to the export and import regulations of other countries in relation to the Materials. These Terms will be governed by US law, without regard to the choice or conflicts of law provisions of any jurisdiction and without regard to your place of residence or use of the Site. You shall bring all disputes, actions, claims, or causes of action related to these Terms or in connection with this Site only in the district and high courts located in CA, US. If any provision of these Terms is held by a court of competent jurisdiction to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties, with all other provisions remaining in full force and effect. The failure of Susteen Inc. to enforce any right or provision in these Terms shall not constitute a waiver of such right or provision unless acknowledged and explicitly agreed to by MyDataPilot in writing. If, for any reason, a court of competent jurisdiction finds any provision or portion of these Terms to be unenforceable, the remainder of the Terms of Service will continue in full force and effect. No joint venture, partnership, employment or agency relationship exists between you and Susteen Inc.
